Terms of Service

Welcome to Fortis. These Terms of Service ("Terms") govern your use of the Fortis website at fortiscoach.ai and the Fortis iOS application (together, the "Service"), operated by Fortis ("we", "us", or "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. The Service

Fortis is an AI-powered weightlifting coaching service. You can upload or record videos of your lifts, and the Service analyzes them to provide technique feedback, coaching cues, drill suggestions, training insights, and live coaching. Feedback is generated by artificial intelligence and is provided for informational and educational purposes only.

We may add, change, or remove features of the Service at any time. We will make reasonable efforts to notify you of material changes that affect paid features.

2. Eligibility and Accounts

• You must be at least 16 years old (or the age of digital consent in your jurisdiction) to use the Service.
• You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
• You agree to provide accurate account information and to notify us promptly of any unauthorized use of your account.

3. Subscriptions, Billing, and Auto-Renewal

• Plans: Fortis offers a free tier with limited monthly analyses and a paid subscription ("Elite") with expanded features. Current pricing is shown in the app and on our website before you purchase.
• App Store purchases: Subscriptions purchased in the iOS app are billed through your Apple App Store account. Payment is charged at confirmation of purchase.
• Auto-renewal: Subscriptions automatically renew for the same period (monthly or annual) unless auto-renewal is turned off at least 24 hours before the end of the current period. Your App Store account is charged for renewal within 24 hours prior to the end of the current period.
• Cancellation: You can manage or cancel your subscription at any time in your App Store account settings (Settings → your name → Subscriptions on iOS). Deleting the app does not cancel your subscription. Cancellation takes effect at the end of the current billing period; fees already paid are non-refundable except where required by law or by Apple's refund policies.
• Free trials: If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription. If you do not cancel before the trial ends, the subscription begins and you will be charged.
• Promo codes: Promotional codes are subject to their stated conditions, may expire or have usage limits, and cannot be exchanged for cash.

4. Your Content and License to Us

• You retain ownership of the videos and other content you submit to the Service ("User Content").
• By submitting User Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, and analyze that content solely to operate the Service - including transmitting your videos to our AI processing providers to generate your coaching feedback.
• As described in our Privacy Policy, uploaded videos are processed to generate feedback and are not used to train AI models or retained long-term on our servers.
• You represent that you have the necessary rights to the content you submit, and that it does not violate any law or the rights of any third party (including people who appear in your videos).

5. Acceptable Use

You agree not to:

• Upload content that is unlawful, harmful, or infringes the rights of others;
• Attempt to gain unauthorized access to the Service, other accounts, or our systems;
• Reverse engineer, scrape, or resell the Service or its AI outputs;
• Use the Service in any way that could disable, overburden, or impair it;
• Share your account credentials or circumvent usage limits of your plan.

6. Health and Safety Disclaimer

Fortis is not a medical service and does not provide medical advice. The coaching feedback, drills, and insights generated by the Service are automated suggestions for informational purposes only. They are not a substitute for professional medical advice, diagnosis, or treatment, nor for in-person instruction from a qualified coach.

• Consult a physician before beginning any exercise program, especially if you have a pre-existing condition or injury.
• Weightlifting carries inherent risks, including serious injury. You assume full responsibility for your training decisions and for lifting within your abilities, with appropriate equipment, supervision, and loading.
• Stop exercising and seek medical attention if you experience pain, dizziness, or other concerning symptoms. Never rely on AI feedback to determine whether a movement is safe for you.

7. AI-Generated Content

Feedback is generated by AI and may occasionally be inaccurate, incomplete, or unsuitable for your situation. We do not warrant the accuracy of any analysis or recommendation. Use your own judgment - and where appropriate, a qualified human coach - when applying feedback to your training.

8. Our Intellectual Property

The Service, including its software, design, branding, and content (excluding your User Content), is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, non-transferable, revocable license to use the Service for your personal, non-commercial training.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

• The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, or for personal injury arising from your training activities, your use of the Service, or your reliance on AI-generated feedback.
• Our total aggregate liability for any claims relating to the Service will not exceed the amount you paid us in the twelve (12) months preceding the claim (or USD $50 if you have paid nothing).

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms excludes liability that cannot be excluded by law.

10. Termination

You may stop using the Service and delete your account at any time from the app's settings. We may suspend or terminate your access if you materially breach these Terms, misuse the Service, or where required by law. Upon termination, your right to use the Service ceases; sections that by their nature should survive (including Sections 6, 7, 9, and 12) will survive.

11. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via email or prominently within the Service before the changes take effect. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.

12. General

These Terms constitute the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver of that right. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
